The project focused on the following areas: policy formulation in respect of IP legislation; outsourcing of government services to the private sector; staff training, public education and awareness of IP rights; and promotion of sound practices by government departments regarding software asset management and enforcement.

Trade (China): Expected Outcome: Assessment of the implications of China’s integration into the world economy, particularly the effects of its WTO accession and potential involvement in regional trade agreements on international trade flows and issues related to the implementation of its WTO commitments. Description: This activity will build on analysis undertaken in the OECD Trade Directorate in 2002 and on-going activities to support trade liberalisation and facilitate the integration of non-members into the international trading system. It will also respond to specific requests from the Chinese government for co-operation on the subject of regional trade agreements. In 2003-2004, the OECD will co-operate with the Chinese Ministry of Foreign Trade and Economic Co-operation to organise a seminar in Beijing on regional trade agreements, drawing on the extensive research carried out in 2002. The OECD will also extend its quantitative analysis of the impact of China’s trade liberalisation on international trade flows and prepare the completed work for publication. A new project will be initiated on the Chinese experience with the implementation of WTO disciplines and commitments. Chinese specialists will be invited to co operate on other projects, such as a study on trade liberalisation in the textile and clothing sectors.

Regulatory Reform (China): Expected Outcome: Support for China’s efforts to improve its regulatory framework and environment in the context of its WTO accession, thus encouraging trade growth and investment in the country. Description: The aim of the activity is to launch a regulatory reform programme for China. The first step is the organisation of a conference to raise awareness and discuss regulatory reform issues. Participants will be senior officials and policy-makers from China, OECD countries and other countries from South-East Asia. Three key regulatory governance issues will be addressed at the conference: (i) improving capacity to assure high-quality regulation; (ii) ensuring law enforcement and (iii) designing an institutional framework for regulators in infrastructure. Participants will exchange experiences in improving the regulatory frameworks in China and in OECD member countries, analyse future challenges, and draft options for practical solutions in China’s reform drive. The event will provide an opportunity to share with China the OECD guiding principles on regulatory reform. The conference is expected to provide support to China’s efforts in improving its regulatory policies and governance.

China's integration into the international trading system: Now that China must manage its integration into WTO as a full member, the trade htmects of this process need to be looked at in conjunction with domestic policies. A joint workshop will suggest ways of making agricultural policies in China more transparent in their design and implementation and more efficient in reaching policy objectives, such as raising farmers' incomes, while complying with WTO rules. The workshop will help the Chinese to develop a methodological framework for policy analysis based on the OECD's classification for PSE/CSE work.

Competition Policy (China): Expected Outcome: (i) Enforcement by Chinese competition officials of China’s new competition law in a predictable and effective fashion; embracing policies, practices and procedures common among members; (ii) development of an international network for co-operation on competition policy and law enforcement. Description: China is currently at a fairly advanced stage of drafting a modern competition law, with OECD assistance. OECD has also been involved in policy dialogue with the relevant enforcement agencies on China’s two existing competition-related laws. In addition, China welcomes capacity-building advice in respect of the reform of regulated sectors – an event focusing on the reform of railroads in China was held early in 2002. Three themes (assisting China to enact a modern competition law, establishment of an effective enforcement regime, and competition-policy-based regulatory reform) will be pursued in 2003-2004, the balance among these themes being adapted to the legislation progress. Activities in 2003 will take the form of: (i) high-level meetings to promote a greater understanding of the law and, more broadly, the benefits associated with its effective enforcement and pro-competitive market reform; and (ii) a seminar with those responsible for enforcing China's Unfair Competition Law and the competition related provisions of China's pricing law. Assuming that the new competition law is passed in 2003, the programme of activities in 2004 will focus on: (i) assisting China to establish a competition agency, (ii) training the agency’s staff and judges, and (iii) developing enforcement guidelines, educational materials for key constituencies. The latter include the legal, business, consumer, press, academic and political communities. Furthermore, and again subject to funding, communications tools will be developed, as well as advocacy strategies, internal case screening criteria, approaches to priority setting, and frameworks.

TA for International Food Safety: Sanitary & Phyto-Sanitary Measures - In March 2002, the U.S. Food & Drug Administration’s (FDA) Center for Food Safety and Applied Nutrition provided a one week training session at FDA on the US food regulatory system for a visiting WHO Fellow from the Ministry of Public Health in China. The program focused on the roles and responsibilities of U.S. food safety agencies, FDA's approaches for regulations of food additives, control of microbial pathogens, transparency, consumer education, etc., and how the US food safety system and programs are operated within the context of WTO SPS. FDA has a long history of working with foreign government organizations to strengthen the scientific, technical or regulatory expertise in other countries. These activities have usually been initiated by foreign governments, but they have also been initiated by FDA to respond to particular issues. FDA's intent in these activities has been to strengthen the overall regulatory and enforcement infrastructure in these countries in order to enhance public health worldwide and to help ensure the viability of the regulatory systems that govern and oversee FDA-regulated products produced in foreign countries and exported to the United States. The activities have the net effect of enhancing the developing countries' abilities to meet U.S. food safety standards, thereby improving market access opportunities in the United States for their food and agricultural products.

Industrial Eco-efficiency: Environment Sector Trade & Standards - In China-US Cooperation in Pollution Prevention and Energy Efficiency EPA cooperates with China State Environmental Protection Administration (SEPA) to establish and implement a more economically efficient environmental management policy for China’s industrial sector, focusing on preventing pollution (source reduction) as a preferred approach to environmental management. EPA cooperates with SEPA to establish comprehensive partnership programs to prevent pollution and conserve energy, including partnerships among relevant parts of the Central Government, partnerships among provincial and local governments and partnerships between government and industry. EPA also cooperates with SEPA to enhance China’s capacity in pollution prevention and energy efficiency and to obtain information about US pollution prevention technologies and policies. To date, 63 facilities in 4 provinces have enrolled in the pilot partnering programs. Implemented by: EPA.

Because of China's uncertainty about the implementation of new Ag-Biotech rules, it has caused new orders for U.S. soybean exports (US$1 billion) to be halted. The focus of the TA and training program would be to help influence implementation procedures to minimize any negative impact on U.S. exports. Also, TDA's focus is, on keeping the Chinese market open to U.S. soybean and corn products and to promote the U.S. lab equipment for food safety testing purposes.
